程序方面，O’Leary 于 2025 年 3 月 26 日起诉；3 月 28 日完成送达。Armstrong 多次未按期限答辩，尽管法院给出延期与明确警告，仍未提交回应。书记员于 5 月 6 日录入缺席；10 月 30 日举行损害赔偿听证，Armstrong 仍缺席。其后以被羁押与双相情感障碍为由申请撤销，法院认为其已获充分通知、拖延近一年且将损害原告利益，遂予以驳回。
