纠纷源于 2025 年 3 月 Armstrong 发布的多条帖文，指控 O’Leary 参与 2019 年一宗致命船艇事故，并在其中一条帖文中公开其私人电话号码，号召粉丝“给现实生活中的杀人犯打电话”。法院查明：O’Leary 当年仅为乘客、未被起诉，其妻子在审理后亦被宣告无罪；事故调查还指出，另一艘船当时未开灯。号码泄露后，O’Leary 接到数百通来电，出于安全考虑每年新增约 20 万美元安保支出，并改变出行与工作动线。
程序方面，O’Leary 于 2025 年 3 月 26 日起诉；3 月 28 日完成送达。Armstrong 多次未按期限答辩，尽管法院给出延期与明确警告，仍未提交回应。书记员于 5 月 6 日录入缺席；10 月 30 日举行损害赔偿听证，Armstrong 仍缺席。其后以被羁押与双相情感障碍为由申请撤销，法院认为其已获充分通知、拖延近一年且将损害原告利益，遂予以驳回。
此案再次警示：在社交平台散布不实指控并“人肉”他人，可能引发高额赔偿与长期法律后果。
