OpenAI Accuses Musk of Disrupting Competitive Environment

On April 7, it was reported that OpenAI recently sent a letter to the Attorneys General of California and Delaware, requesting an investigation into Elon Musk and related individuals, alleging “misconduct and anti-competitive behavior.” This move comes ahead of a highly publicized lawsuit trial between the two parties.

According to Jason Kwon, OpenAI’s Head of Strategy, in the letter, Musk has attempted to weaken OpenAI’s business and development through various means in recent years, including coordinating actions with Meta CEO Mark Zuckerberg and launching a series of “attacks” against the company.

The conflict between OpenAI and Musk dates back to the company’s founding. In 2015, Musk, Sam Altman, and others co-founded OpenAI, which was then positioned as a non-profit organization. Musk left the company in 2018, after previously attempting to push for integration between OpenAI and Tesla.

Subsequently, in 2024, Musk filed a lawsuit against OpenAI, accusing the company of misleading him during its transition toward a profit-oriented structure. At the same time, Musk founded a new AI company, xAI, and launched the Grok series models, directly competing with OpenAI.

According to arrangements, the relevant cases will be heard in the Northern District of California Federal Court, with jury selection expected to begin on April 27.

OpenAI stated in the letter that Musk’s actions could hinder the company’s efforts to develop Artificial General Intelligence (AGI). AGI generally refers to AI systems capable of performing a wide range of tasks at or above human intelligence levels.

The company also cited media reports that Musk and his associates have engaged in so-called “opposition research” against Altman, including tracking his schedule and spreading allegations against him. Musk has not publicly responded to these claims.

Chris Lehane, Head of Global Affairs at OpenAI, said the company believes some of Musk’s behaviors “warrant investigation,” and questioned why some of the most influential figures in the tech industry are trying to prevent a non-profit organization from advancing its mission.
