A man stopped his vehicle on the highway to help someone, but a secondary accident occurred, resulting in 1 death and 3 injuries. The man was held secondarily responsible!

At 5:00 p.m. on January 27, 2026, Mr. Xu was driving along a section of the Changchun–Yanchang Expressway in Jilin. He saw a Buick vehicle involved in a single-vehicle accident, with four people waiting for rescue in the emergency lane. Seeing this, Mr. Xu immediately backed up, pulled over and parked in a nearby emergency lane, turned on his hazard lights, and, after getting out with his wife, helped them report to the police.
However, more than ten minutes later, a vehicle coming from behind rear-ended the Buick, lost control, spun around, and crashed into the four people in the emergency lane, resulting in 1 death and 3 injuries.
The Traffic Police Detachment of the Jilin Highways Public Security Bureau’s Jilin Expressway Police Patrol Fifth Brigade issued an accident determination letter, concluding that Mr. Xu bore the secondary responsibility for the secondary accident.
Reporters learned that on that day, Lin Moumou drove a Buick sedan with a Liaо A license plate. The car had 3 passengers. The vehicle accidentally crashed into the guardrail. After the accident, Lin Moumou and the 3 passengers moved to the emergency lane on the expressway.
At this time, Mr. Xu, who was driving in front of the accident vehicle, saw the occurrence through his rearview mirror. He backed up to return to the scene, wanting to see whether there was anything that needed help.
At 5:38 p.m., when Yao Moumou drove a small sedan with a Ji J license plate onto the road section, he directly crashed into the Buick sedan that was still occupying the passing lane and the driving lane. After the two vehicles collided, Yao’s vehicle instantly lost control and spun. During the spinning, it struck Lin Moumou and three other passengers who were in the emergency lane. Among them, passenger Wang Moumou unfortunately died, while driver Lin Moumou and two other passengers were injured.
Neither Mr. Xu nor his wife was injured in this secondary accident. But the scene frightened Mr. Xu’s wife badly. After Mr. Xu called the police, he drove away with his wife, leaving the scene.
What he did not expect was that afterward he received a call from the police for an investigation, and in the end he was determined to bear secondary responsibility in this injury accident.
“My car wasn’t hit. I only got out to help rescue people—how am I considered to be a secondary party responsible?” Mr. Xu couldn’t understand.
According to the vehicle inspection report issued by the police, before the secondary accident occurred, the speed of Yao’s vehicle was 111 kilometers per hour. About 4 seconds before the collision, Yao pressed the brakes; the speed dropped to 110 kilometers per hour. Then he released the brakes and, more than 1 second before the collision, braked again until the crash. At the time of the collision, the vehicle speed was 72 kilometers per hour.
In addition, before the crash, Yao made multiple changes to the steering wheel operation: he first turned the wheel slightly to the left. After he realized he could not avoid the Buick, he straightened the wheel, then turned the wheel to the right several times. In the instant before the collision, he suddenly turned the wheel to the left again. Ultimately, he collided with the Buick, causing the vehicle to spin out of control.
The traffic police department analyzed the causes of the accident: the main reason was that when Yao was driving, he did not drive safely in accordance with operational procedures; there were two secondary reasons. First, after Lin Moumou’s accident, he did not place warning signs as required. Second, after Mr. Xu parked on the expressway, he also did not set up warning signs according to the regulations.
Mr. Xu told the reporter that the expressway where the incident occurred had two one-way lanes, plus an emergency lane. After the Buick accident, the Buick lay across the middle of the road, occupying the passing lane and the driving lane. His car was parked in front of the Buick in the emergency lane. “I also admit that because it was pretty urgent at the time, the vehicle was not completely stopped within the emergency lane,” Mr. Xu said. At that time, the tire at the left rear side was on the driving lane, but it did not affect the passage of vehicles behind him, because the two cars were about 40 meters apart. Therefore, Mr. Xu believes that his car did not affect other vehicles’ passage, and whether a warning sign was present also had no connection to whether the secondary accident occurred.
“If my car had also been hit, then I would also accept that responsibility,” Mr. Xu said.
The reporter contacted the Jilin Expressway Police Patrol Fifth Brigade for this matter. A relevant负责人 said that the determination of responsibility was reached through discussions between the brigade and the accident handling department. Based on comprehensive on-site inspection, investigation and evidence collection from multiple parties, and statements from passing drivers, the process is rigorous, fair, and just, and fully withstands verification. Not setting warning signs in accordance with regulations is one of the bases for determining that Mr. Xu is responsible. The负责人 also said that the case materials for this accident are as many as over 100 pages. The brigade does not have the authority to accept interviews or discuss case details, and the reporter should contact the local public security traffic police’s external publicity department.
It is understood that after the local traffic police department issued the accident determination letter, Mr. Xu submitted a written application for reconsideration.
